The publication in 1957 of the Wolfenden Report occasioned a celebrated controversy in which profound theoretical issues concerning the relation between law and morality, and the legal enforcement of morality were discussed. The principal disputants were Lord Justice Devlin and Professor H. L. A. Hart. It is by now well known that the main recommendation of the Wolfenden Report was the reform of the criminal law so that homosexual behaviour in private between consenting male adults should no longer be a (...) criminal offence. As homosexual behaviour in Christendom was at the outset punishable in the ecclesiastical courts, and subsequently, with the demise of the ecclesiastical courts, in the secular courts, the Wolfenden recommendation on homosexuality marked a major departure from the prevailing state of affairs in which the precepts of Christian morality, especially relating to sexual morals, were at first enforced by the ecclesiastical courts, and then by the secular courts. T. A. Cavanaugh defends double-effect reasoning (DER), also known as the principle of double effect. DER plays a role in anti-consequentialist ethics (such as deontology), in hard cases in which one cannot realize a good without also causing a foreseen, but not intended, bad effect (for example, killing non-combatants when bombing a military target). This study is the first book-length account of the history and issues surrounding this controversial approach to hard cases. It will be indispensable in theoretical ethics, applied (...) ethics (especially medical and military), and moral theology. It will also interest legal and public policy scholars. (shrink)

The present work is motivated by recent experiments aimed to measure the propagation velocity of bound electromagnetic field that reveal no retardation in the absence of EM radiation. We show how these findings can be incorporated into the mathematical structure of special relativity theory that allows us to reconsider some selected problems of classical and quantum electrodynamics. In particular, we come to the conclusion that the total four-momentum for a classical system “particles plus fields” ought to be a present state (...) function of moving charges if EM radiation is negligible. In quantum domain, we analyze novel definition of the momentum operator recently suggested in the study of quantum phase effects. It implies that bound EM field energy and momentum are to be present state functions, too. Being in agreement with reported experiments, these conclusions suggest the necessity to carry out more precise experimental verifications for additional and independent determination of propagation properties of bound EM fields. A scheme of a possible experiment on this subject is also proposed. (shrink)

It seems that Derrida objects to Gadamer's hermeneutics on the grounds that it is, as Gadamer puts it, "a discipline that guarantees truth," taking it as something that partakes in the "metaphysics of presence." However, this criticism is based on a misunderstanding of the nature of hermeneutic truth. It would be on target if hermeneutic truth were some kind of universal condition of correspondence. Gadamer has tried to correct this conception of hermeneutic truth in his various attempts at opening a (...) dialogue with deconstructionism. In this article, the author argues that in a possible debate between hermeneutics and deconstructionism, there are good reasons to judge in favor of the former. (shrink)
